1. Agreement to Terms

By accessing or using the website of Adriatic Builders LLC ("Company," "we," "us," or "our"), including adriaticbuilders.com (the "Site"), or by engaging our services, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use our Site or services.

These Terms constitute a legally binding agreement between you and Adriatic Builders LLC, a California limited liability company, licensed contractor (CSLB License #929606 B, C-10, C-46).

2. Services Overview

Adriatic Builders LLC provides general contracting, electrical, and solar installation services in the San Francisco Bay Area, California. Our services include but are not limited to:

  • Remodeling and construction services (kitchen, bathroom, home additions)
  • Electrical services (panel upgrades, rewiring, EV chargers, smart home installation)
  • Solar and energy services (solar installation, repair, inverter replacement, energy storage)

All services are subject to separate written contracts and proposals. This website and these Terms do not create a contract for services.

3. Estimates, Quotes, and Contracts

3.1 Estimates

Free consultations and estimates provided through our website or phone are preliminary and non-binding. Final pricing requires an in-person site assessment and written proposal.

3.2 Written Contracts Required

All construction and contracting work requires a written contract signed by both parties. Per California Business and Professions Code Section 7159, contracts for home improvement work exceeding $500 must be in writing and include specific disclosures.

3.3 Right to Cancel

California law provides you with a 3-business-day right to cancel certain home improvement contracts. This right will be clearly stated in any written contract we provide.

4. Limitations of Liability

4.1 Website Use

TO THE MAXIMUM EXTENT PERMITTED BY CALIFORNIA LAW, THE SITE AND ALL INFORMATION PROVIDED ARE OFFERED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

4.2 Service Limitations

Project timelines, costs, and scope described on this Site are estimates only and may vary based on site conditions, material availability, permit approval times, weather, and other factors beyond our control. Actual terms will be specified in written contracts.

4.3 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ADRIATIC BUILDERS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

5. Licensing and Compliance

Adriatic Builders LLC holds the following licenses:

  • California Contractors State License Board (CSLB) License #929606
  • Classification B (General Building Contractor)
  • Classification C-10 (Electrical Contractor)
  • Classification C-46 (Solar Contractor)

All work is performed in compliance with California building codes, electrical codes, and local ordinances. Permits are obtained as required by law.

6. Payment Terms

Payment terms are specified in individual service contracts. Generally:

  • Down payment required before work begins (as allowed by California law, typically not exceeding $1,000 or 10% of contract price, whichever is less, for initial deposit)
  • Progress payments may be required based on work completion
  • Final payment due upon substantial completion and final inspection
  • Late payments may incur interest charges as permitted by California law
  • Liens may be filed for non-payment as permitted under California Civil Code Section 8400 et seq.

7. Service Quality and Project Completion

7.1 Workmanship

We perform all work in a professional manner consistent with industry standards. Specific quality standards, completion criteria, and project protection are defined in individual written contracts. Any representations made on this website are general in nature and do not constitute contractual commitments.

7.2 Equipment and Materials

Equipment and materials are covered by manufacturer warranties where applicable. We are not the manufacturer and make no independent warranties regarding equipment performance or longevity. Solar panels, inverters, electrical components, and other equipment carry manufacturer warranties ranging from 1-25 years depending on the product.

7.3 Labor Coverage

Labor coverage periods are specified in individual contracts and vary by project type. We stand behind our work and will address any issues arising from our workmanship during the agreed-upon period specified in your written contract. This does not include damage from homeowner modifications, natural disasters, normal wear and tear, or issues caused by third parties.

8. Project Changes and Change Orders

Changes to project scope, materials, or specifications after contract execution require written change orders. Additional work beyond original scope will be priced separately. We reserve the right to charge for changes that impact project timeline or require additional permits.

9. Delays and Force Majeure

Project timelines are estimates. We are not liable for delays caused by: weather conditions, permit approval delays, material shortages, labor shortages, utility company delays, site conditions, homeowner-requested changes, acts of God, government actions, or other circumstances beyond our reasonable control.

10. Site Access and Homeowner Responsibilities

Homeowners are responsible for:

  • Providing clear and safe access to work areas
  • Removing or protecting personal belongings and valuables
  • Securing pets during work hours
  • Maintaining utilities (water, electricity) unless otherwise arranged
  • Notifying us of any hazardous materials (asbestos, lead paint) that may be present

11. Dispute Resolution and Governing Law

11.1 Governing Law

These Terms and any disputes arising from our services shall be governed by the laws of the State of California, without regard to conflict of law provisions. Venue for any legal action shall be in the county where the project is located or in Alameda County, California.

11.2 Arbitration

Individual service contracts may contain arbitration clauses. Any arbitration shall be conducted in accordance with California Code of Civil Procedure Section 1280 et seq.

11.3 CSLB Complaint Process

Before pursuing legal action, California law requires parties to attempt resolution through the Contractors State License Board (CSLB). Complaints may be filed with CSLB at (800) 321-2752 or www.cslb.ca.gov.

12. Indemnification

You agree to indemnify, defend, and hold harmless Adriatic Builders LLC, its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from: (a) your violation of these Terms, (b) your violation of any rights of another party, (c) your failure to disclose known hazardous conditions on your property, or (d) your modifications to our completed work.

13. Intellectual Property

All content on this Site, including text, graphics, logos, images, and software, is the property of Adriatic Builders LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

14. Insurance and Bonding

Adriatic Builders LLC maintains:

  • General liability insurance as required by California law
  • Workers' compensation insurance for all employees
  • Contractor's license bond as required by CSLB

Proof of insurance can be provided upon request for active projects.

15. DISCLAIMER OF WARRANTIES

EXCEPT AS EXPRESSLY PROVIDED IN A WRITTEN SERVICE CONTRACT, ALL SERVICES AND WEBSITE CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT:

  • The Site will be uninterrupted, timely, secure, or error-free
  • Information on the Site is accurate, complete, or current
  • Any defects will be corrected
  • The Site is free of viruses or harmful components
  • Results from service use will meet your expectations

16. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY CALIFORNIA LAW:

  • IN NO EVENT SHALL ADRIATIC BUILDERS LLC BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES
  • OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM WEBSITE USE SHALL NOT EXCEED $100
  • FOR CONTRACTED SERVICES, LIABILITY IS LIMITED TO THE AMOUNT PAID UNDER THE SPECIFIC CONTRACT
  • WE ARE NOT LIABLE FOR DAMAGES CAUSED BY FACTORS BEYOND OUR REASONABLE CONTROL
  • WE ARE NOT LIABLE FOR PRE-EXISTING CONDITIONS, HIDDEN DEFECTS, OR UNDISCLOSED SITE CONDITIONS

Some jurisdictions do not allow limitations on implied warranties or limitation of liability for incidental or consequential damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

17. User Responsibilities and Prohibited Uses

You agree not to:

  • Use the Site for any unlawful purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Site or servers
  • Impersonate any person or entity
  • Collect information about other users
  • Submit false or misleading information
  • Use automated systems to access the Site without permission

18. Project Photography and Marketing

We may photograph completed projects for marketing purposes. If you prefer your project not be photographed or used in marketing materials, please notify us in writing before work begins. By allowing photography, you grant us a non-exclusive, royalty-free license to use project images in our marketing materials, website, and social media.

19. Permits and Inspections

We obtain required permits for our work. However, homeowners are ultimately responsible for ensuring their property complies with all local codes and regulations. Permit approval times are outside our control and may affect project timelines. Permit fees are typically separate from labor and materials costs unless otherwise specified in writing.

20. Termination

We reserve the right to refuse service or terminate agreements if: (a) you breach these Terms, (b) you provide false or misleading information, (c) payment issues arise, (d) site conditions are unsafe, or (e) we determine in good faith that we cannot complete the project as contracted. Termination procedures and responsibilities are specified in individual service contracts.

21. Severability

If any provision of these Terms is found to be unenforceable or invalid under California law, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

22. Entire Agreement

These Terms, together with any written service contracts, constitute the entire agreement between you and Adriatic Builders LLC regarding use of our Site and services, superseding any prior agreements or understandings.

CALIFORNIA HOMEOWNER NOTICE

As required by California law, you are entitled to the following information:

  • Contractor License Information: Our license number is 929606. You can verify our license status at www.cslb.ca.gov or by calling (800) 321-2752.
  • Right to File Complaint: You have the right to file a complaint with the Contractors State License Board if you believe we have violated contractor licensing laws.
  • Mechanic's Lien Rights: Under California law, contractors, subcontractors, and suppliers may have the right to file a mechanic's lien on your property if they are not paid for work performed.
  • Three-Day Right to Cancel: For certain home improvement contracts, you have three business days to cancel. This right will be specified in your written contract if applicable.
  • Joint Control: For projects over $5,000, you may establish a joint control account as provided in California Business and Professions Code Section 7159.5.
